These General Conditions of Sale regulate purchases of products and services made remotely by the buyer via the internet on the website www.kingsgym.it belonging to KINGSGYM S.R.L, with headquarters in Via Ettore Majorana 4 int G, 50019 Sesto Fiorentino , Florence, tax code and registration no. to the Company Register 07223630489.

The contract stipulated between KINGSGYM S.R.L and the Customer must be considered concluded with the acceptance of the order by KINGSGYM S.R.L. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to be of age and to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions of sale and payment set out below.< /p>

The Customer can purchase the products visible at the address www.kingsgym.it as described in the relevant information sheets at the time of placing the order. Correct receipt of the order is confirmed by KINGSGYM S.R.L through a response via e-mail, automatically sent to the e-mail address communicated by the Customer. The message presents the items ordered and all the data entered by the Customer who undertakes to verify their correctness and promptly communicate any corrections.

KINGSGYM S.R.L reserves the right to eliminate, add and modify the products on the site without notice.

Reference Regulations

The sale of products and services via electronic means is regulated by Legislative Decree no. 206/2005 “Consumer Code” and by Legislative Decree no. 70/2003 "Regulations on Electronic Commerce".

The sales contract stipulated between the Customer and KINGSGYM S.R.L will be governed and interpreted in accordance with Italian law.

Prices

All prices on the website www.kingsgym.it are inclusive of VAT (22%).

KINGSGYM S.R.L reserves the right to change prices at any time, without notice.

The products will be sold at the prices indicated online at the time the order is confirmed by the Customer. Shipping costs will be added to this amount as reported at the time of purchase.

Order Cancellations

KINGSGYM S.R.L will have the right to cancel or suspend the order in question, in whole or in part, if circumstances arise such as to determine a significant change in the conditions that led to the stipulation of the order itself.

Payment Methods

* Credit card – At no time during the purchase procedure will KINGSGYM S.R.L be able to know the information relating to the credit card used, which must be entered directly on the platform of the institution that will manage the transaction, where you will be directed.

* Via Paypal - you will be directed to the secure PayPal page where you can complete the payment directly from your PayPal account. By choosing this payment method, any refunds will be credited back to the Paypal account of origin.

* Via Klarna - you will be directed to the secure PayPal page where you can complete the payment directly from your Klarna account. By choosing this payment method, any refunds will be credited back to the Klarna account of origin.

* By cash on delivery - IN CASH, upon receipt of the goods, directly to the courier who delivers. Cash on delivery is optional for orders with maximum amounts of €999.00. This payment method includes an additional cost for the service.

* By bank transfer - The order will be sent only when the amount due is actually credited to the current account of KINGSGYM S.R.L which must take place within 7 (seven) working days from the date of the order. After these deadlines the order will be cancelled. Here are our accreditation details:

Shipping and Delivery

Transport costs are automatically calculated by the site, based on weight and destination and can be consulted during the "check out" phase.

Where possible and unless otherwise indicated, the customer will have the right to choose between a shipment by Express Courier and a shipment by National Courier. Costs and times may vary depending on this choice and will be indicated during the selection phase.

All shipments will be made using the standard service offered by the courier used. Any deliveries by appointment or customized must be agreed upon when ordering, as well as any additional services, such as porterage and delivery to the floor, where available. If the customer requests an extra paid service, the amount of this service will be added to the total to be paid to KINGSGYM S.R.L.

Usually, if the order placed by the customer exclusively concerns goods ready for delivery, this is processed and entrusted to the courier within 24-48 hours following the payment being credited. For all those products not ready for delivery you will be contacted by customer service to agree on details and timing. Once entrusted to the courier, the timing will depend on the type of courier selected and may be influenced by any additional services requested: with the use of an express courier, delivery usually takes place within 24-72 hours, while with a national courier, delivery may require longer times. long. In any case, the timing is always to be considered indicative and KINGSGYM S.R.L cannot under any circumstances be considered responsible for any delays in delivery.

Upon delivery of the goods by the Courier, the Customer is required to check:

- that the number of packages delivered corresponds to what is indicated in the Courier's accompanying document

- that the packaging is intact, not damaged, wet or altered.

If even just one of these conditions is not valid, it is essential that the Customer accepts the goods subject to inspection. If the Customer fails to sign with reservation, no it will be possible to make any objection regarding the quantity and quality of the goods received.

Following receipt of the goods, the Customer will have 10 days to report any problems relating to delivery (missing, incorrect items, etc.).

Right of Withdrawal

The customer has the right to exercise the right of withdrawal, without penalty and without the need to specify the reason, within 14 (fourteen) days of receipt of the goods. To exercise this right, it is necessary to send a written communication to the e-mail address info@kingsgym.it, specifying the order number and the products being returned. The same communication can be sent via certified e-mail, registered letter, telegram, telex, e-mail or fax, provided that it is confirmed within 48 hours by registered letter with acknowledgment of receipt.

International Shipping

Deliveries to international destinations usually take 3-8 working days, depending on the geographic region. We ship to the following countries with the corresponding rates:

The right of withdrawal is subject to the following conditions:

1) Return of the Product Intact: The purchased good must be returned completely intact, in the original factory conditions, that is, in its original packaging, complete with all its parts, including internal packaging and any documentation included; Any anomaly or defect in the product could give rise to the cancellation of the refund of the amount.

2) Shipping Costs and Free Shipping Benefit: The shipping cost for the delivery of the products, as well as any costs deriving from ancillary services explicitly requested by the Customer (such as deliveries by appointment or porterage) , initially incurred by KINGSGYM SRL, will not be subject to reimbursement;

Please note that in the event that the total amount of the order exceeds 99 euros, the Customer will be entitled to benefit from free shipping as part of the purchase. This benefit is only applicable to successful and confirmed orders. However, in the event of the Customer exercising the right of withdrawal, any concession previously granted in terms of free shipping will be automatically revoked. The Customer will be responsible for covering all shipping costs initially incurred by KINGSGYM S.R.L, according to the following rates:

Once we have received the goods and verified their integrity, we will provide a refund within the legal terms.

Please note that the right of withdrawal can be exercised exclusively by customers who hold the position of consumer pursuant to the relevant legislation, i.e. by natural persons who have purchased the products for their own use and for purposes not related to their professional activity.

Any products made to measure and/or personalized are excluded from the right of withdrawal.

Legal guarantee

Each product sold by KINGSGYM S.R.L to a "consumer" buyer is covered by the 24-month legal guarantee for defects of conformity, as required by the relevant legislation.

The Legal Guarantee applies to all products that present a lack of conformity, which manifested itself within 24 months of delivery, which was not known at the time of purchase. There is a lack of conformity, for example, when a product does not work as it should, when it cannot be used for the purposes for which it was intended or does not have the characteristics or qualities declared by the seller. However, the legal guarantee does not cover defects other than those inherent to the conformity of the goods, such as those arising due to bad or incorrect use, nor the consequences of normal wear and tear of the goods.

In order to assert the Legal Guarantee it is necessary to communicate the presence of the defect within 2 months of it being discovered.

If a defect appears within 6 months of delivery of the product, it is assumed, unless proven otherwise, that it was already present at the time of delivery. Once these deadlines have elapsed, however, the relevant legislation provides that any causes other than lack of conformity must be excluded ("reversal of the burden of proof").

In the event of a lack of conformity, KINGSGYM S.R.L will restore conformity through repair or replacement, at no cost to the Customer. It will also be possible to opt for a suitable price reduction or termination of the contract (not foreseen in the presence of modest defects) in cases where:

- repair and replacement are impossible or excessively expensive in relation to the value of the product;

- it is not possible to carry out the repair or replacement within a reasonable time;

- repair or replacement involves significant inconvenience.

It is however necessary to consider that the repair times or possible replacement of the product depend exclusively on the manufacturer's policies and no damage can be requested from KINGSGYM S.R.L for any delays in carrying out repairs or replacements.

In the event that, for any reason, KINGSGYM S.R.L is unable to replace a product under warranty, it may proceed, subject to the Customer's consent, to replace the product with another of equal characteristics and value or, to issue a purchase voucher of the same amount that can be spent on another product, valid for 6 months from the moment of issue.

Additional Guarantees

If indicated on the product sheet, which can be consulted on the website www.kingsgym.it, the purchase of a good may include an additional guarantee which is applied, unless otherwise indicated, exclusively in the case of purchase by a "consumer" customer ” and to the extent indicated on the product sheet. This warranty covers damage that is not attributable to improper use of the product and/or incorrect installation/maintenance. Furthermore, alteration of the product always voids the warranty. Please note that any effects attributable to normal wear and tear of the product are not covered by the warranty. The warranty right can only be exercised by the original owner.

Competent Court

For any dispute between the parties in this regard, the court of the place of execution of the contract is competent.
