Terms and Conditions of Sale

These General Terms and Conditions of Sale govern purchases of products and services made remotely by the purchaser via the internet on the website www.kingsgym.it, owned by KINGSGYM S.R.L, with registered office at Via Ettore Strobino 35/30, 59100, Prato, PO, Tax Code and Companies Register No. 07223630489.

The contract concluded between KINGSGYM S.R.L and the Customer is deemed finalized upon acceptance of the order by KINGSGYM S.R.L. Such acceptance shall be considered tacit unless otherwise communicated to the Customer by any means. By placing an order using the methods provided, the Customer declares to be of legal age, to have read all the information provided during the purchase procedure, and to fully accept the general terms and conditions of sale and payment set out below.

The Customer may purchase the products displayed at www.kingsgym.it as described in the respective product information sheets at the time the order is submitted. Proper receipt of the order is confirmed by KINGSGYM S.R.L by an email automatically sent to the address provided by the Customer. The message lists the items ordered and all data entered by the Customer, who undertakes to verify their accuracy and promptly communicate any corrections.

KINGSGYM S.R.L reserves the right to remove, add, and modify the products on the website without notice.

Applicable Law

The sale of products and services by electronic means is governed by Italian Legislative Decree No. 206/2005 (the “Consumer Code”) and Italian Legislative Decree No. 70/2003 (the “E-Commerce Regulations”).

The sales contract entered into between the Customer and KINGSGYM S.R.L shall be governed and interpreted in accordance with Italian law.

Prices

All prices shown on www.kingsgym.it include VAT (22%).

KINGSGYM S.R.L reserves the right to change prices at any time without notice.

Products will be sold at the prices indicated online at the time the Customer confirms the order. Shipping costs, as shown at checkout, will be added to the total amount.

Order Cancellations

KINGSGYM S.R.L may cancel or suspend the order, in whole or in part, if circumstances arise that significantly alter the conditions that led to the acceptance of the order.

Payment Methods

* Credit card – At no time during the purchase process will KINGSGYM S.R.L have access to the credit card information, which must be entered directly on the platform of the institution handling the transaction, to which you will be redirected.

* PayPal – You will be redirected to PayPal’s secure page where you can complete payment directly from your PayPal account. If this payment method is selected, any refunds will be credited back to the originating PayPal account.

* Klarna – You will be redirected to Klarna’s secure page where you can complete the payment.

* Cash on delivery – Cash upon receipt of the goods, paid directly to the courier making the delivery. Cash on delivery is available for orders up to €999.00 and carries an additional €10 service fee.
This method is available in Italy only.

* Bank transfer – The order will be shipped only once the amount due has actually been credited to KINGSGYM S.R.L’s bank account, which must occur within 7 (seven) working days from the order date. After this period the order will be canceled. Bank details:

Shipping and Delivery

Transport costs are calculated automatically on the website based on weight and destination and are shown at checkout.

Where possible and unless otherwise indicated, the Customer may choose between Express Courier and National Courier. Costs and delivery times may vary accordingly and will be indicated at the time of selection.

All shipments will use the standard service offered by the designated courier. Any scheduled or customized deliveries must be arranged at the time of order, as well as any ancillary services, such as handling and delivery to floor level, where available. If the Customer requests an extra paid service, the cost of such service will be added to the total amount payable to KINGSGYM S.R.L.

Typically, where the Customer’s order concerns only items in ready stock, it is processed and handed over to the courier within 24–48 hours after payment is credited. For products not in ready stock, Customer Service will contact you to agree on details and timing. Once handed over to the courier, timelines depend on the selected courier type and may be affected by any ancillary services requested: using express courier, delivery in Italy usually takes 2–5 business days, while international courier deliveries may require longer. In any case, delivery times are indicative and KINGSGYM S.R.L cannot be held liable for any delays.

Upon delivery by the Courier, the Customer must check:

- that the number of packages delivered matches the transport document;

- that the packaging is intact, not damaged, wet, or otherwise altered.

If any of these conditions are not met, the Customer must accept the goods with reservation. If the Customer fails to sign with reservation, no claims regarding the quantity or quality of the goods received can be made.

After receiving the goods, the Customer has 10 days to report any delivery-related issues (missing items, incorrect items, etc.).

International Shipping

International deliveries generally take 3–8 business days, depending on the destination. We ship to the following countries, applying these rates:

Right of Withdrawal

The Customer may exercise the right of withdrawal, without penalties and without having to specify the reason, within 14 (fourteen) days from receipt of the goods. To exercise this right, a written notice must be sent to info@kingsgym.it, specifying the order number and the products to be returned. The same notice may be sent via PEC, registered letter, telegram, telex, email, or fax, provided it is confirmed within the next 48 hours by registered letter with return receipt.

The right of withdrawal is subject to the following conditions:

1) Return of the Product in Intact Condition: The purchased item must be returned completely intact, in its original factory condition, i.e., in its original packaging, complete with all parts, including internal packaging and any included documentation. Any anomaly or defect in the product may result in the refund being denied.

2) Shipping Costs and Free Shipping Benefit: The shipping cost for delivery of the products, as well as any costs arising from additional services expressly requested by the Customer (such as scheduled deliveries or handling), initially borne by KINGSGYM S.R.L, will not be refundable.

Please note that if the total order amount exceeds €499, the Customer is entitled to free shipping as part of the purchase. This benefit applies only to successful, confirmed orders. However, if the Customer exercises the right of withdrawal, any previously granted free-shipping benefit will be automatically revoked. The Customer will be responsible for covering all shipping costs initially borne by KINGSGYM S.R.L, according to the following rates:

3) Customer’s Responsibility: The Customer must securely package all products to prevent damage and arrange, at their own care and expense, the return of the product within 10 working days from the notice of withdrawal. For the purpose of meeting the deadline, the goods are considered returned when handed over to the shipper/carrier.

4) Custody of Goods: The goods will remain under the full responsibility of the Customer until delivery to our warehouse.

Once the goods are received and their integrity verified, we will issue the refund within the terms provided by law.

Please note that the right of withdrawal may be exercised exclusively by customers qualifying as consumers under the relevant legislation, i.e., natural persons who purchased the products for their own use and for purposes unrelated to their professional activity.

Custom-made and/or personalized products are excluded from the right of withdrawal.

Legal Warranty

Each product sold by KINGSGYM S.R.L to a consumer is covered by a 24-month legal warranty for lack of conformity, as provided by applicable law.

The Legal Warranty applies to all products that present a lack of conformity occurring within 24 months from delivery and not known at the time of purchase. A lack of conformity exists, for example, when a product does not function as it should, cannot be used for its intended purpose, or does not have the characteristics or qualities declared by the seller. The legal warranty does not cover defects unrelated to conformity, such as those arising from improper or incorrect use, nor the consequences of normal wear and tear.

To enforce the Legal Warranty, the presence of the defect must be reported within 2 months of its discovery.

If a defect appears within 6 months of delivery, it is presumed, unless proven otherwise, to have existed at the time of delivery. After this period, the law provides that causes other than lack of conformity must be excluded (“reversal of the burden of proof”).

In the event of a lack of conformity, KINGSGYM S.R.L will, at no cost to the Customer, restore conformity by repair or replacement. It is also possible to opt for an appropriate price reduction or contract termination (not available for minor defects) in cases where:

- repair or replacement is impossible or excessively burdensome in relation to the value of the product;

- repair or replacement cannot be carried out within a reasonable time;

- repair or replacement would cause significant inconvenience.

Please note that the duration of repair or possible replacement depends exclusively on the manufacturer’s policies, and no damages may be claimed from KINGSGYM S.R.L for any delays in carrying out repairs or replacements.

If, for any reason, KINGSGYM S.R.L is unable to replace a product under warranty, it may, with the Customer’s consent, replace it with another product of equal characteristics and value or issue a purchase voucher of equal amount to be used for another product, valid for 6 months from the date of issue.

Additional Warranties

Where indicated on the product page on www.kingsgym.it, the purchase of a good may include an additional warranty which, unless otherwise specified, applies exclusively in the case of a purchase by a consumer and to the extent indicated on the product page. This warranty covers damage not attributable to improper use of the product and/or incorrect installation/maintenance. Furthermore, any alteration of the product will void the warranty. Please note that effects attributable to normal wear and tear are not covered. The warranty right may be exercised only by the original owner.

Jurisdiction

For any dispute between the parties, the competent court shall be that of the place where the contract is performed.
